Judicial Panel to Reconsider Ruling That Allowed Trump to Send Troops to Portland

The federal appeals court has upheld a prohibition on deploying national guard in the Oregon city, after a latest legal decision.

Appeals Court Concurs to Rehear Legal Matter

The federal appeals court ruled on this week that it would rehear the case concerning the president’s authority with an larger panel of 11 judges. The judicial body also overturned a earlier ruling from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Troop Deployment

This order represents the most recent development in a long-running legal battle over whether the former president has the authority and valid reason to deploy state military units in Portland. Approximately two hundred troops have been in uncertainty since the end of September when the deployment effort was started in response to months of protests.

Differing Viewpoints

The administration has claimed that federal officials at the ICE facility in the southern part of the city were under attack, while city and state officials maintain that municipal police have command of the situation.

In defiance of characterizations of Portland as “war ravaged”, residents have been posting videos of scenic paths and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city enacted two legal injunctions this month – one blocking the federal control of the state troops, and another prohibiting the use of any military personnel in the state, after attempts to circumvent the first order by mobilizing out-of-state forces.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing control of 200 Oregon national guard – but the second ruling remained in place, preventing the physical sending of the forces.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with all decisions under consideration simultaneously – by a group of 11 judges.

“This ruling shows that facts are important and that the courts are striving to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a official comment.

“The judicial body is sending a clear message: the executive leader cannot dispatch the armed forces into US cities unnecessarily. We will continue defending state legislation, principles, and sovereignty as this legal proceeding moves forward and our fight continues in the judicial system.”
